Can waiting to see a doctor hurt your Florida crash claim?

On Behalf of | Jun 8, 2026 | Auto Accidents

You may feel sore but “fine” after a Tampa car accident, especially when adrenaline is still high. But waiting too long to see a doctor can create problems for both your recovery and your insurance claim.

Why the 14-day deadline matters

To qualify for Personal Injury Protection (PIP) benefits, you need initial medical services within 14 days after the crash. If you miss that deadline, the insurer may deny PIP medical benefits tied to the accident.

Timely care also affects how much coverage may be available. To access the full $10,000 in PIP benefits, a medical doctor, osteopathic physician, dentist, physician assistant or advanced practice registered nurse must diagnose an emergency medical condition (EMC). A chiropractor may provide initial treatment, but they are not legally authorized under Florida law to make the EMC diagnosis required to access the full benefit. Without that diagnosis, medical benefits may be capped at $2,500.

How delays can affect your claim

Even if your injury is legitimate, a delay in treatment can make the insurer question what caused it. Some injuries worsen after the first day. However, insurance adjusters may use a gap in treatment to argue that:

  • A different event caused your pain
  • Your injuries are minor
  • You waited too long to take reasonable steps for recovery

These arguments can lead to lower offers or disputed benefits. Early medical records can connect your symptoms to the collision.

Protect your records before delays affect your claim

Keep copies of discharge papers, prescriptions, imaging results, work restrictions, wage records and insurance letters. These records can show when your symptoms started, what treatment you received and how the crash affected your ability to work or handle daily tasks.

Do not let delayed care make a difficult claim harder. Prompt medical attention can protect your health and create a clearer record. If your injuries are serious or the insurer questions treatment, speaking with an attorney can help you understand your options before deadlines or PIP limits create more problems.
